Terms of Service: Garda TVA

1. Provider

VOLANTA S.R.L., registered office Strada Lunca Sighet nr. 22, 440063 Satu Mare, Romania, tax ID (CUI) 55533620, Trade Register no. J2026052939002, not registered for VAT ("Volanta", "we"). Contact: richard@volanta.ai.

2. The service

Garda TVA consists of (a) a free check, without an account, of the tax status of Romanian tax IDs (CUI) and (b) subscription-based monitoring of supplier lists, with periodic (normally daily) checks and alerts on status changes.

3. Business customers only

The service is only for companies, sole traders and other professionals acting for their business or profession. By creating an account or subscribing you confirm that you act for that purpose and not as a consumer. We do not accept subscriptions entered into as a consumer.

4. Account

Sign-in is passwordless, via a link sent to the account email address. You are responsible for the security of that mailbox and for activity in the account. You can delete the account and its monitoring data at any time from the account page.

No VAT is added, because Volanta is not registered for VAT. Payment is by card through the payment processor Stripe. We may change prices with at least 30 days' notice by email; a new price applies from the first billing period after the notice period.

6. Free trial

Your first subscription includes a free 14-day trial, once per customer. A payment card is required to start the trial. Unless you cancel before the trial ends, the subscription starts automatically and the first monthly fee is charged when the trial ends.

7. Auto-renewal and cancellation

The subscription renews automatically every month until cancelled. You can cancel at any time in the billing portal (Account → Billing and subscription); cancellation takes effect at the end of the current paid period, until which the service remains available. Partial periods are not refunded, except as stated in section 15. Plan changes are made in the same portal; price differences are prorated by the payment processor as shown when you confirm the change.

8. Invoicing

Invoices are issued under Romanian law, including through the RO e-Factura system where it is mandatory. You are responsible for the accuracy of the billing details (name, tax ID, address) entered at checkout or in the billing portal.

9. Informational tool: not tax advice

Garda TVA displays public information and flags situations that may have tax consequences. Results are for information only and are not tax, accounting or legal advice. References to the Romanian Fiscal Code are indicative. Decisions on the tax treatment of a transaction (for example deducting VAT) are yours and should be made with your accountant or tax adviser.

10. Data sources

Tax status is obtained from the public web service of the Romanian National Agency for Fiscal Administration (ANAF) for taxpayer checks (PlatitorTvaRest), which draws on ANAF registers (VAT registration, VAT on a cash basis, inactive/reactivated taxpayers, RO e-Factura register). We show the data as provided by ANAF, without modification. We do not guarantee the accuracy, completeness or timeliness of ANAF data or when ANAF updates its registers.

11. Availability

The service depends on the availability of the ANAF web service and of our infrastructure providers. If ANAF does not respond or limits access, checks and alerts may be delayed or missed. We do not offer a guaranteed service level (SLA). We may carry out maintenance, normally without significant interruption.

12. Acceptable use

You may not: automate the free check beyond the displayed limits, circumvent technical limits, resell the data in bulk, use the service unlawfully, or attempt to disrupt the service or the ANAF service.

13. Personal data

We process account data as described in the Privacy notice. Supplier lists mainly contain data about legal entities. To the extent they contain personal data (for example the tax ID of a sole trader), you are the controller and Volanta acts as processor (Art. 28 GDPR): we process such data only to provide the service, following the instructions given by your use of the account; we ensure confidentiality and appropriate security; we use infrastructure providers (Cloudflare, for hosting and database) and, for email, the email provider named in the Privacy notice as sub-processors; we help you respond to data subject requests; we delete the data when you delete the list or account; and we provide, on request, the information needed to demonstrate compliance.

14. Limitation of liability

To the extent permitted by law: (a) Volanta’s total liability to a customer for any cause related to the service is limited to the amounts that customer paid for the service in the 12 months before the event giving rise to liability; (b) Volanta is not liable for indirect loss, lost profits, fines, tax interest or penalties, or the refusal of a deduction right, decisions that remain the customer’s responsibility under section 9; (c) the free check is provided "as is". These limitations do not apply to damage caused intentionally or by gross negligence, or where the law does not allow liability to be limited.

15. Suspension and termination

We may suspend or close an account that breaches these terms, with notice by email. You may end the contract at any time by cancelling and deleting your account. If Volanta discontinues the service, we will give at least 30 days’ notice and refund the paid, unused part of the current period pro rata.

16. Changes to these terms

We may change these terms. For active subscribers, changes affecting their rights are notified by email at least 30 days before they apply; if you disagree, you can cancel before that date. The current version is published on this page.

17. Governing law and disputes

These terms are governed by Romanian law. We will try to resolve any disagreement amicably by email; otherwise disputes are settled by the competent courts at Volanta’s registered office. The Romanian version prevails over this English translation.
